Les normes au sens le plus large sont issues des interactions entre les individus et sont interprétées au sein de ces interactions, même si la complexité des interactions tient aussi à l'intervention des institutions et des Etats. Il s'agit de partir du micronormatif pour aller vers le macronormatif (notamment les lois et les traités) et non l'inverse, de manière à rendre compte de phénomènes comme la responsabilité sociale des entreprises, le droit souple et la prise en compte de l'éthique pour (...) prendre des décisions (au plan national et international, en matière environnementale et médicale, etc.). Le constat de départ est qu'une masse colossale de normes de toute origine s'applique à des individus, personnes physiques ou morales, qui à leur tour participent de l'élaboration de normes. L'inflation et la diversification des normes engendrent notamment une crise du droit (en quête d'identité), mais aussi une crise des institutions et des professions judiciaires. Une façon de rendre compte de ces crises consiste à établir une sorte de cartographie des interactionnismes au regard des normes. Emergent ainsi des interactionnismes philosophiques, sociologiques, anthropologiques, psychologiques, éthiques ou juridiques. Les différents interactionnismes peuvent apparaître critiquables au regard des normes (notamment en raison de leur caractère descriptif et non institutionnel) et il serait fort utile de dégager des voies alternatives. L'introduction met en place cette problématique (E Picavet et E Jeuland). Après une recherche théorique et pratique menée par des juristes (E Jeuland et L Champain), un sociologue des professions (F Champy) nous permet de penser l'évolution des professions judiciaires entre statut et adaptation. Une philosophe spécialisée dans l'interactionnisme (C Bonicco) ainsi qu'une psychanalyste (H Tessier) s'interrogent sur les normes implicites, non dites et les rapports de domination sous-jacents aux interactions. Un philosophe spécialisé dans la justice climatique et le nucléaire ouvre un nouveau champ de réflexion particulièrement nécessaire aujourd'hui en incluant la nature au sein des interactions humaines (F P Piguet). Deux ingénieurs nous présentent une approche des interactionnismes et de l'innovation technologique (J F Omhover et C Bouchard) qui n'est pas sans lien avec la nature et le droit. Un anthropologue estime que le droit tel qu'il est connu depuis deux ou trois siècles dans une version très étatique est en plein bouleversement et revient à des formes microjuridiques (Etienne le Roy). Un juriste essaie enfin de faire la synthèse des articulations entre les normes et les interactions (J Moret-Bailly). Il en ressort une présentation transdisciplinaire des différents versants du problème de la relation entre les normes et les individus. (shrink)

Constitué d'analyses et de réflexions sur les méthodes pratiquées aujourd'hui dans l'écriture de l'histoire de la philosophie, cet ouvrage vise à rendre compte de la différence des pratiques existant selon les traditions et à interroger l'existence d'une démarche historique spécifique au domaine de la philosophie. L'enjeu fondamental est donc de savoir s'il existe une historiographie propre à la philosophie. Les interrogations portent en particulier sur les questions des critères d'exactitude, de vérification, de crédibilité qui permettraient de distinguer et de décider (...) entre les interprétations. In this article, I discuss Gerbert Faure’s Vrije wil, moraal en het geslaagde leven (Free Will, Morality, and the Well-lived Life). I summarize and elucidate Faure’s argument. My criticisms are directed primarily at the first chapter of the book, in which Faure develops what he regards as a Strawsonian account of free will and moral responsibility. Faure denies that we have free will; I argue that Strawsonians should not deny this. Faure argues that, although we do not have free (...) will, it is often justified to hold others responsible, because we owe it to the victim(s) of a wrong to hold the perpetrator responsible; it is our moral duty. I argue that we only have a moral duty to hold perpetrators responsible if they are morally responsible. I also comment on the way in which Faure presents Strawson’s distinction between theory and practice. (shrink)

This article focusses on the generality of the entities involved in a geometric proof of the kind found in ancient Greek treatises: it shows that the standard modern translation of Greek mathematical propositions falsifies crucial syntactical elements, and employs an incorrect conception of the denotative letters in a Greek geometric proof; epigraphic evidence is adduced to show that these denotative letters are ‘letter-labels’. On this basis, the article explores the consequences of seeing that a Greek mathematical proposition is fully general, (...) and the ontological commitments underlying the stylistic practice. Schelling's first systematic attempt to articulate a complete philosophy of nature.

In a lengthy article E. Scerri and J. Worrall put forward the case for a novel ‘accommodationist’ version of the events surrounding the development of Mendeleef's Periodic Table 1869–1899. However these authors lay undue stress on the fact that President of the Royal Society of London Spottiswoode made absolutely no mention of Mendeleef's famous predictions in the Davy Medal eulogy in 1883 and undue stress on the fact that Cleve's classic 1879 Scandium paper contained an acknowledgement of Mendeleef's prior prediction (...) of eka-boron.They also fail to analyse in any detail the so-called ‘rare earth problem’ which, in the opinion of this author, causes problems for their account but not for a predictivist account. My discussion addresses the differences between analytic and continental philosophy concerning the use of logic and exact reasoning in philosophical practice. These differences are mainly examined in the light of the controversial dominance of Hegel's concept of logic (and theory of concept) in twentieth-century continental philosophy. The inquiry is developed in two parts. In the first (Sections 1-2), I indicate some aspects of the analytic-continental divide, pointing to the role that the topic 'logic and philosophy' plays in it. In the (...) second part (Sections 3-6), I give a short account of the views of logic which are typical of the three main trends of continental philosophy (see Table 1). I also suggest how, with the aid of some typical analytical devices, some continental 'anti-logical' attitudes may be corrected, on their own terms. (shrink)

Appearing in English for the first time, Schelling’s 1842 lectures develop the idea that many philosophical concepts are born of religious-mythological notions.

In a paper entitled "Revolution in Permanence", published in the collection "Karl Popper: Philosophy and Problems", John Worrall severely criticised several aspects of Karl Popper's work before commenting that "I have no doubt that, given sufficient motivation, a case could be constructed on the basis of such remarks that Popper had a more sophisticated version of theory production......". Part of Worrall's criticism is directed at a "strawpopper": in his "Darwinian Model" emphasising the similarities and differences between genetic mutation, variation in (...) animal behaviour and the gestation of scientific theories, Popper never stated that tentative scientific conjectures "while more or less random, are not completely blind." He was referring to variation in animal species behaviour, and about tentative scientific conjectures he said nothing, although common sense would indicate that presumably he regarded them as being less blind and less random. In Popper, giving a summary of his "Darwinian Model", he repaired this omission about tentative scientific conjectures by inserting the sentence "On a level of World 3 theory formation they are of the character of planned gropings into the unknown." Recent developments in the field of genetics, Lewis, Korn ) indicate that Popper's intuitions were along the modern lines while Worrall's intuitions are old fashioned. Therefore Popper's "Darwinian Model" remains both viable and fruitful. (shrink)

Background A morally sound framework for benefit-sharing is crucial to minimize research exploitation for research conducted in developing countries. However, in practice, it remains uncertain which stakeholders should be involved in the decision-making process regarding benefit-sharing and what the implications might be. Therefore the study aimed to empirically propose a framework for benefit-sharing negotiations in research by taking HIV vaccine trials as a case. Methods The study was conducted in Tanzania using a case study design and qualitative approaches. Data were (...) collected using in-depth interviews (IDI) and focus group discussions (FGD). A total of 37 study participants were selected purposively comprising institutional review board (IRB) members, researchers, community advisory board (CAB) members, a policymaker, and HIV/AIDS advocates. Deductive and inductive thematic analysis approaches were deployed to analyze collected data with the aid of MAXQDA version 20.4.0 software. Results The findings indicate a triangular relationship between the research community, researched community and intermediaries. However, the relationship ought to take into consideration the timing of negotiations, the level of understanding between parties and the phase of the clinical trial. The proposed framework operationalize partnership interactions in community-based participatory research. Conclusion In the context of this study, the suggested framework incorporates the research community, the community being researched, and intermediary parties. The framework would guarantee well-informed and inclusive decision-making regarding benefit-sharing in HIV vaccine trials and other health-related research conducted in resource-limited settings. Neuroscience has studied deductive reasoning over the last 20 years under the assumption that deductive inferences are not only de jure but also de facto distinct from other forms of inference. The objective of this research is to verify if logically valid deductions leave any cerebral electrical trait that is distinct from the trait left by non-valid deductions. 23 subjects with an average age of 20.35 years were registered with MEG and placed into a two conditions paradigm (100 trials for (...) each condition) which each presented the exact same relational complexity (same variables and content) but had distinct logical complexity. Both conditions show the same electromagnetic components (P3, N4) in the early temporal window (250–525 ms) and P6 in the late temporal window (500–775 ms). The significant activity in both valid and invalid conditions is found in sensors from medial prefrontal regions, probably corresponding to the ACC or to the medial prefrontal cortex. The amplitude and intensity of valid deductions is significantly lower in both temporal windows (p = 0.0003). The reaction time was 54.37% slower in the valid condition. Validity leaves a minimal but measurable hypoactive electrical trait in brain processing. The minor electrical demand is attributable to the recursive and automatable character of valid deductions, suggesting a physical indicator of computational deductive properties. It is hypothesized that all valid deductions are recursive and hypoactive. (shrink)
